Ohio Construction Reform

The Construction Reform Law substantially changed the contracting processes for public-improvements in Ohio.

Contracting arrangements (commonly “project delivery system” or “project delivery method”) that are now available to Ohio’s public owners include:

  • Design Build
  • Construction Manager at Risk (also known as Construction Manager Constructor)
  • Single-Prime General Contractor
  • Construction Manager Agent (also known as Construction Manager Advisor)
  • Traditional Multiple Prime Contractors

Other Construction Reform changes include subcontractor prequalification, a mandated form of subcontract, “best-value” selection, open-book project pricing, and new surety bonding rules.

Unique Insight...

Ken Fisher was the only private-practice attorney member of the multi-agency working group which drafted the administrative rules, contracts, and related documents to implement Ohio’s Construction Reform Law. Ken's continued involvement with Ohio Construction Reform includes the 2014 and 2015 refinements of the contracts and related documents.
